Rules for Withdrawal from the Contract and Complaints
A.RULES FOR WITHDRAWAL FROM THE CONTRACT
- Consumer who has concluded a Distance Sales Agreement may withdraw from it within 14 days without giving any reason. In the event of withdrawal from a Distance Sales Agreement, the contract is considered null and void.
- The right to withdraw from the contract under the terms specified in this document also applies to individual Entrepreneurs. Where the term Consumer is mentioned in this attachment, it is also understood to mean an individual Entrepreneur.
- In the event of withdrawal from the contract, the Consumer only bears the direct costs of returning the Goods.
- The Consumer's statement must clearly express their intention to withdraw from the contract. In particular, the Consumer may:
a) Use the electronic return form available on the Online Store's website at the address below:
https://shop39281-1.yourtechnicaldomain.com/returns-open.php.
b) Withdraw from the contract using the withdrawal form provided in Attachment No. 2 to the Polish Consumer Rights Act of May 30, 2014 (Dz.U. 2023, item 2759).
c) Withdraw from the contract by independently formulating a statement and sending it to the Seller's email address; the statement should include all information necessary to identify the order, including the Buyer's details and the order number.
d) The Seller will promptly confirm receipt of the withdrawal statement by email. - To meet the deadline, it is sufficient to send the statement before it expires, i.e., within 14 days from the date of order receipt.
- The period for withdrawal from the contract begins for a contract under which the Seller delivers the item, being obliged to transfer its ownership, from the moment the Consumer or a third party other than the carrier indicated by the Consumer takes possession of the Goods.
Effects of Withdrawal from the Contract
- The Seller will, within 14 days of receiving the withdrawal statement and receiving the Goods in an undamaged condition, refund all payments made by the Consumer, including the delivery costs corresponding to the cheapest delivery method offered by the Seller.
- The Seller will withhold the refund to the Client until they receive the Goods back undamaged or receive proof of their return shipment, whichever occurs first.
- The refund will be made using the same payment method used by the Consumer unless the Consumer uses the Electronic return form to exercise the right of withdrawal - the funds will be returned using the chosen method and to the bank account provided by the Consumer.
- The Consumer should return the Goods to the Seller (or to a person authorized by the Seller to receive them) promptly, but no later than 14 days from the date they withdrew from the contract. To meet the deadline, it is sufficient to send the Goods before the period expires. The Consumer should send the returned Goods to the return address specified in the Online Store in the country from which they placed the order or directly to the Seller's address in Poland.
- The Consumer is responsible for any reduction in the value of the Goods resulting from using them in a way that exceeds what is necessary to ascertain their nature, characteristics, and functionality.
- The Consumer returns the Goods at their own expense.
B. COMPLAINTS
- A complaint regarding a defect in the Goods or non-compliance of the Goods with the concluded Distance Sales Agreement can be submitted via:
a) The electronic complaint form available online on the Online Store's website at: https://shop39281-1.yourtechnicaldomain.com/returns-open.ph or
b) By sending an email to: contact@oldschool-fishing.com, indicating the order number, describing the defect or non-compliance of the Goods with the contract, and attaching photos of the complained Goods or
c) In writing to the Seller's registered address in Poland. - Based on the complaint submitted by the Client, the Seller will respond to the complaint within 14 days of receiving it. If the Seller does not respond to the Client within the specified period, the complaint is considered valid.
- The Consumer has the right to request a price reduction if the Seller:
a)Refused to repair or replace the Goods,
b)Did not repair or replace the Goods,
c)Attempted to repair or replace, but the Goods are still non-compliant with the Agreement,
d) Declared that they would not repair or replace the Goods within a reasonable time or without significant inconvenience to the consumer. - The Consumer has the right to demand withdrawal from the contract in case of significant non-compliance with the Agreement.
- If the non-compliance with the contract is significant, the Consumer can demand a price reduction or withdraw from the Agreement without first using the right to request repair or replacement.
- If the Seller accepts the complaint as justified, the costs of replacement or repair and the costs of shipping related to the complaint of the Goods are borne by the Seller.
- The Seller is responsible to the Consumer, as well as the individual Entrepreneur, for the non-compliance of the Goods with the Distance Sales Agreement on the principles arising from the Act of May 30, 2014, on Consumer Rights (Dz.U. 2023, item 2759).
- The Seller is liable for the non-compliance of the Goods with the Distance Sales Agreement existing at the time of their delivery and revealed within two years from that moment.
- The Seller undertakes to repair or replace the Goods with the same defect-free Goods or to remove the defect within 14 days of accepting the complaint. The costs of repair or replacement, including transport, labor, and materials, are borne by the Seller.
- The Consumer makes the Goods available to the Seller for repair or replacement with a new, defect-free item (the same). If the Seller considers the complaint justified, the Seller will reimburse the Consumer for the complaint shipping costs.
- The Seller is obliged to deliver defect-free Goods and is responsible to the Entrepreneur for defects in the purchased Goods under the terms specified in the Polish Civil Code.
